Employment Update - April 2009

Changes to Unfair Dismissal Laws from 1st July 2009

As you would know, the Fair Work Act passed through Parliament on 20 March 2009.

Majority of the Fair Work Act is to commence operation from 1 July 2009, with the balance to commence on 1 January 2010.

The Fair Work Act 2009 will completely replace the Workplace Relations Act 1996 and with it will bring a number of changes to the Federal workplace relations system that we have come to know through WorkChoices.

In this Issue

  • What defines a small business for the purpose of unfair dismissal?
  • What is the Small Business Dismissal Code?
  • How have the exemptions to unfair dismissal changed?
  • The role of Fair Work Australia in determining unfair dismissal claims
  • Main implications for employers
